Do you have a link to the agreement? I couldn't find anything on a quick UN/Forums search.

If they are just using the old rules, they already had an exception for guilds raiding in hate or killing trash:

I don't see any rules that allow unguilded characters to stay on a mini spawn, while guilds are always required to leave. Just schedule raids and/or trash clears around the Magi spawn timer(s) if you really want to contest Magi.
