Well, the reason for IP law is to ensure your ideas are protected. The idea behind IP law is that without it there would be a chilling effect on innovation. I.e., if your ideas can't be protected then why would you bother coming up with any ideas? So the answer to your question is that IP law is better for gaming, because it begets ideas and innovation. Without IP law, you would've never had EverQuest in the first place, and I think we can all agree we wouldn't like that outcome!
And Daybreak is actually an extremely reasonable IP holder. They allow private emulated servers like P99 to exist as long as you don't make many changes to the IP and as long as you don't monetize it beyond dollar-for-dollar what your expenses are for server upkeep/maintenance. Do you know how many companies would never allow that? I mean, look at Blizzard and private WoW servers...they try to shut those down.
As for your other quote, I'm not sure saying "hey you make 1 comment about THJ for every 100 I make" is the gotcha you think it is lol
