57th earth pet has max 3200 hps without foci.
The 49th pet has max 3700 hps with foci.
The 49 pet still wins till you get a staff.
It only wins on hit points, but you're forgetting the extra levels and damage that it does. The root also has a DD component. Once you try it you'll see how much better it is.
