Bush acknowledged that, which yes would have likely resulted in another trial, and found guilty yet again as he admitted to the crime when he was arrested.

Ultimately, the treaty was unclear, so the SCOTUS ruled 6-3 that the state court was not bound to the treaty. Either way, the outcome would have been the same, just that the defendant would have been eligible to have his phone call. Unfortunately the big picture, now it can be used against US citizens imprisoned abroad.
