He was really there just to loot and destroy an item off a corpse with 10 minuets left on it.

The only one risking somebody getting murdered over a TV is the person who resorts to violence to acquire a TV.
Yeah let me clarify that if I see someone stealing a TV I'm not shooting him but if they break into my home I am.

This is true.

Killing someone who has invaded your home is generally not recognized as murder though. And for good reason. Why should any victim be forced bear the risk of an aggressive act perpetrated by someone else? The problem is uncertainty. First the invaders motives are unknown. Second even benign motives may change upon their discovery. The invader runs the risk of prosecution if caught, so the stakes are raised in any encounter. That makes the discoverer a threat to the invader whether armed or not. Inaction by the discoverer could result in tragedy. Of course the counter argument is that action could also result in tragedy. Tragedy is tragedy, plain and simple. If we are forced to favor one side or the other though (which we are), who ought we favor? The person who has already suffered an act of aggression? Or, the person who has perpetrated that act?

A man's home is his castle. In his castle he has beloved items, whether they be materialistic or living beings.

If a person makes the choice to break laws by invading, then they've made a choice which is not rational nor legal.

Motive.....it's all about motive.

In some states (like mine) you cannot use lethal force to defend property. Someone robbing your house? Can't shoot them. Only when your own life is threatened by equally lethal force can you use a gun to defend yourself.
Even in a state like yours...

A good lawyer and some money can change the result of the case.
