I guess I am not grasping the difference between items being stolen and a character being deleted. Is the only difference that it is much easier to restore the character?

If someone is trying to do something malicious, all they need to do is transfer all of the items to a level 1. That way, the person who owns the account loses all of their items. If they delete the character, per the policy, that is no problem for the account owner because the character is restored.

By not giving the items back to the original owner, all you do is encourage account stripping. If you ban the person's main character that is doing the stripping, and return the items to the main owner, I bet you get rid of 90% of your account stripping problems.
