This presents a very interesting legal problem. Whatever it was that tony did, the question is did it create a reasonable certainty that that kid would be seriously injured. That is enough for murder in most states. Probably just get him for wreckless homicide, or maybe nothing.

On a side note, if tony reved his engines to scare him, then that intent would be imputed for purposes of committing battery and wrongful death, with some nice punative damages.
Tony is going to owe that dumb ass red neck's family big chunk of change. Sadly it'll be gone in one generation or less.

Tony Stewart isn't going to get in any trouble for this. The worst case scenario for him is that he looses sponsors. He may end up paying a big settlement in civil court, but don't count on him being convicted of a crime.

tony is fine, Darwinism took the kid out for running around in black on a dirt track (poor lighting)midrace. Revving up to turn/swerve is how those cars work. Literally he wasn't mad that some kid wrecked. The kid was mad and had something to prove but went about it all wrong. Also I live a few minutes from there and know that track fairly well.

Tldr: terrible accident but is the victims fault. Rip

I'm no expert. But it looked to me that he was being reckless with his vehicle.
I think many others on this board agree. So I would say speak for yourself.

There is no doubt that he will pay millions on a civil suit.

A couple of the other cars almost hit him when he was walking out, I can't believe the dude kept coming after those near misses.

yes he did the guy went "full retard" and put himself and others directly in danger and got killed. Tony has to live with the guilt of this accident as well its a shame people bias their decisions on past actions. This race was nothing to nascar racers and is something tony does to keep his driving up between real races. RIP ward

What the fuck are some of you smoking? The only reckless or purposeful actions here are the dumbass getting out of his car and running over to stand in front of a moving vehicle during a race.
