Actually it always seemed to me that the gaurds would attack whichever player character attacked first. I know freeport gaurds always disliked me and then eventually I became KOS from guard hunting. But I remember getting into a few duels and when the noob would hit me first the gaurds who were dubious to me would beat their face in. Also I remember dueling in EC many times and if I hit the other player first, things like firebeetles and such if they were near would jump in and start beating on me even though normally they arent KOS.
