Daybreak does not spend a lot of money maintaining EQ. Even though Time locked Progression servers are probably losing numbers over time, they still bring in multiple thousands of new players/accounts/monthly subs every year from players that are hooked on them like the community here is hooked on p99. The difference in the two communities is that their TLP Cash shop with exp potions, race changes, 40 slot bags, etc. is BOOMING every year at TLP time and otherwise depending on the month and what new rainbow familiar they reskin. I don't doubt that they would love to delete all of the private servers, if not acquire and instantly monetize them. The cashflow for EG7/Daybreak from the Everquest IP is still very viable and lucrative in 2025. I wish they would just respect the fanbase and give P99 the permission to support themselves more through the obviously very willing community here so that maybe the future of this Project could not be such a mute subject.
Unlikely. Every corporation is an investment firm these days and I don't expect Darkpaw Studios or whatever they're called now has more than 5 developers and 2 admins.

The parent company will probably dump debt on them at some point and they'll have to file for Chapter 7. You'll still get to play it's a pretend funny money bankruptcy like with Mr Trump in his ventures.

You also agree to delay future Project 1999 release dates as reasonably requested by Daybreak to avoid similar conflicts.

It reads to me in the text text that daybreak has to basically approve of any future release or p99 runs the risk of nullifying the contract.

But then inquiring to daybreak puts you back in the cross hairs, so even that can make it risky IMO

ChatGPT:

It certainly doesn’t stop them but it does make it more risky.
Yeah that's not what that language says. It doesn't require Daybreak's consent to launch a new server. If it did, it would explicitly say that they won't launch one without
Daybreak's express prior written consent.

Now, if Daybreak finds out they are launching Green 2.0 and wants to ask them to delay it for a long time...they can of course do so, but under that language they'd have to provide a reason other than "because we said so" and if that reason wasn't reasonable then P99 could ask a court to allow them to launch the server. Would P99 do that? I'm guessing probably not since it would be time consuming and expensive to litigate whether Daybreak's justification was "reasonable". So if they didn't then yeah that language kind of could be used to prevent them from launching a server. But if P99 went to court it would probably have a good shot at winning.

If you're just arguing over "reasonableness" then it's not impossible they would do it. That's likely one hearing and no real discovery now that I think about it

I am more keen to listen to chatgpt and disagree with your assessment CD but you can argue about it with chatGPT not me.

I really doubt DBG has any intention of actually going to court over any of this.

I do think Chat GPT (or an equivalent) will be a good legal resource eventually. Currently my advice is to take anything it says on legal stuff with a grain of salt. Not just about this obviously, but if you ever need it in other areas of your life for a legal answer.

It's just a powerful data aggregator and isn't able to do true nuanced analysis. I've asked it regulatory questions before and found it's answers to either be fully incorrect or incomplete because it's mass searching based on key words and phrases, but not able to actually interpret or understand context.

I think they're just still working on the timeline stuff and want it to be even more perfect but that the goal line always moves further away as they get closer.
