I signed no terms and conditions when the pic was posted in 2003. There was a big thing in the media, which is why there are terms and conditions on modern sites.

Even then, the picture is consented for the organisation where it is posted to use, not anyone else.

I looked up a few articles and can say you are wrong when it comes to Australian Law.
