without all the cash made from those EoM's, there would be no quantitative evidence that daybreak was losing revenue to THJ.

What should have happened, was THJ should have reached out to DBG a lot earlier, and started building a relationship that would have resulted in THJ being on the liver server select, or free to exist like P99.
Or what also should have happened is the investment capital firm should have encouraged DBG to enter into an agreement to absorb THJ into the live servers and acquired the two devs that made it to manage it. | ||

is the evidence even needed really? in ages past EQ's ip holder has sent out C&D based solely on a project being popular and using the IP, i forget the exact wording but both Winter's Roar and EQClassic got threatened with legal action over i assume just in theory siphoning potential customers away by making a superior product with the assets | ||
