“you also agree to delay future project 1999 release dates as reasonably requested by daybreak to avoid similar conflicts.”

Best to just put him on ignore
What ... it has been 14 years now playing on P99.

8) Release of the Velious Expansion. You agree not to release the Project 1999 ''Velious"
expansion until August 1, 2015, to avoid a potential conflict with the release of Daybreak's
progression server at the end of May. You also agree to delay future Project 1999 release dates
as reasonably requested by Daybreak to avoid similar conflicts.

My understanding of the history there is that when Velious was about to launch Daybreak was launching a TLP. So P99 pushed the release of Velious back so that it wouldn't compete with the launch of the TLP.

I don't think that's saying they can't launch another server without permission. It's saying that if Daybreak makes a reasonable request for them to delay the launch (such as if it's overlapping with a TLP launch, like the release of Velious on Blue was) then P99 will agree to delay temporarily.

It reads to me in the text text that daybreak has to basically approve of any future release or p99 runs the risk of nullifying the contract.

But then inquiring to daybreak puts you back in the cross hairs, so even that can make it risky IMO

ChatGPT:

Quote:
How to Follow This Properly & Legally:
1. Maintain Open Communication with Daybreak
Proactively inform Daybreak of your upcoming release plans.
Ask if they anticipate any scheduling conflicts.

Keep a formal or documented communication channel (e.g. email) for tracking requests and responses.
2. Assess Requests for Reasonableness
"Reasonably requested" gives you some discretion.
A request would be reasonable if:
It is made in good faith,
It is related to a legitimate concern (like a Daybreak release),
It is not excessively burdensome (e.g., asking for a delay of months without cause could be unreasonable).
Unreasonable requests (e.g. “don’t release for a year for no reason”) may not have to be honored, but you should document your reasoning and possibly seek legal advice before rejecting.
3. Document All Delays and Requests
Keep a written record of:
The date of Daybreak’s request,
The content of the request,
Your internal response and actions taken,
Any relevant correspondence.
4. Avoid Independent Releases That Conflict with Daybreak
If you plan a release, and Daybreak informs you that their schedule includes a competing product at the same time, you must delay.
Work with them on selecting an alternative date that avoids conflict.
5. Have a Process for Adjusting Future Dates
Make your release dates provisional or “subject to change based on coordination with Daybreak” to maintain flexibility.
It certainly doesn’t stop them but it does make it more risky.

Do you really outsource all your critical thinking to a computer?

Daybreak does not spend a lot of money maintaining EQ. Even though Time locked Progression servers are probably losing numbers over time, they still bring in multiple thousands of new players/accounts/monthly subs every year from players that are hooked on them like the community here is hooked on p99. The difference in the two communities is that their TLP Cash shop with exp potions, race changes, 40 slot bags, etc. is BOOMING every year at TLP time and otherwise depending on the month and what new rainbow familiar they reskin. I don't doubt that they would love to delete all of the private servers, if not acquire and instantly monetize them. The cashflow for EG7/Daybreak from the Everquest IP is still very viable and lucrative in 2025. I wish they would just respect the fanbase and give P99 the permission to support themselves more through the obviously very willing community here so that maybe the future of this Project could not be such a mute subject.
