I received this news today from TheGamer regarding Nintendo's lawsuit against a modder. I'm not certain how much money the guy made in the end after he pays the $2M fine, but he's better off than the other guy the article mentions. That guy has to fork over $10M and that's after more than a year in jail.

One more point. Note that Daly settled out of court which probably kept the fine low. The other guy went all the way to trial and lost. You can read about that in this article. So, when you start to compare these cases against DBG's case, it sure does indicate the final result. Right now it's just a matter of how long THJ can drag it out, but I have a feeling that's not a viable strategy in the long run because it just makes it more and more expensive for them in lawyer fees and inevitable fines or settlement.

I see your point about the numbers but I don't think that's the sole reason. I just have a feeling it's more about the money, but population could definitely be a factor as well. When I played p99 back in 2011 for the first time, I think we were routinely hitting over 2k in peak times. I do not recall if it was over 3k or not. I've played on and off since then, but I don't recall any EQ emu hitting 2k before THJ although Shards of Dalaya could be one that did. It was popular before I got into the emu.

the Sony 2014 hack happened in retaliation for them going after a console modder, so there's that to consider also

Did they go to jail for the infringement or for being a contempt ignorey bear?

Idk but xathos does bring up a good point that going all the way through the court is risky for THJ i bet, Ive heard before settling is much better than what loosing would be in general.
