The thj lawsuit does not care about your concerns.
This is big boy stuff.
They dont care about your feelings as to what Everquest *should* be.
The developers most likely knew they were wrong but got a bit in front of themselves.
No matter how much we wish that thj was everquest, it is not the *vision* of the current IP owners.

Those in charge of the purse strings at DBG and the holding company own your arse in all things everquest. The thj devs seemed to forget that.
I'll bet you they are remembering it now.

The funniest thing to me is I dont believe DBG and its holding company even lost any money. Those who played thj may, or may not not have played live EQ at all. All they needed to prove is harm.

So, shovel, in closing nobody cares about your feewings, what you want everquest to be makes zero difference in this lawsuit. What everquest *could be* has zero to do with this lawsuit.
Cry more.

They already have, the case is closed the only thing left is to determine settlement and who else is culpable. As of right now the only thing the defense has in their favor is a recommendation of arbitration which would prevent criminal charges but I think unless they pocketed enough cash to pay damages then DBG will fight that.

After the smoke clears you can bet the IRS will come knocking.

It's easily beaten in this case because THJ did not shut down for the initial injunction request. It's not necessarily in DBG's favor to do that though unless THJ didn't keep enough cash to satiate a settlement. They're going to bring in as many people as they can and see what kind of payout they can get.

I thought this was one heckuva sentence.

the misuse of intellectual property rights does not undermine the Parties’ “clear and unmistakable” intent to delegate whether to arbitrate arbitrability to an arbitrator via incorporation of the AAA Rules.
