I sympathize with this situation. Seems like there was some sort of miscommunication. The infringement was KS followed by an apology. If no earring dropped, we can't be too upset. Sure it would be nice if people checked their tells before rushing into combat, but the game doesn't guarantee that. His actions didn't seem intentional. And regardless of what he said, the only known violation was this un-frapsed situation. I'm no gm but seems like case closed. Shake hands, move on. Share the spawns.
