Nobody in the world thought they were going to "overthrow" the government. They were trying to keep the current government regime in power by smearing poop on the walls and stealing from offices.

Just because they failed so miserably doesn't mean they didnt commit those acts with the intention of doing so.

I think its also beyond debate when there are people in prison right now for seditious conspiracy.

No. They are locked up on the charge. They were convicted. Now they are locked up awaiting sentencing. I dont think they made bail or were even offered bail.

They're in jail for something else.

No. If you're arrested on a warrant of seditious conspiracy, you're in jail for that charge until you make bail or face your trial. Then, after you're convicted and awaiting sentencing, you are still locked up on that same charge.
