Patents, trademarks and copyright law are far more about who can can afford to defend themselves and pay legal fees than they are about validity of a case.
Regardless of validity of claim you will lose if you can't afford to win. Nobody cares about the merits of claims anymore. If you have an attorney and are willing to pay them then they will do their lame lawyer thing, right or wrong. I have witnessed companies pay money to avoid the legal process because paying is cheaper than lawyers even though if they defended themselves they would win. So freaking lame our whole legal system. | ||
