There's this looming esoteric question of what it means to be human and whether humanity is worth it.
The biggest problems we face are technology and class furthering all divides of inequality while rampant unchecked and unsustainable growth is permitted, selected for, and encouraged.
The end result will be a separation of those with the ability and means to control the game and take what they want, from those locked outside the city walls, sentenced to death through poverty, or placed in camps to be destroyed.
Your story is good, and it represents the ephemeral struggle of our lives and tribal identities. However it doesn't beg the question of what is humane, better, will work, achievable in our lifetime. It simply looks at the standard model of human behavior and accepts it as immutable.
Perhaps I'm a deviant for thinking outside of the box and envisioning a world defined not by fear, but a desire to create a human condition worthy of the natural wonder of the universe.

If he did this, it would certainly be reversed and tied up in courts for years and most likely deemed unconstitutional.

However, that doesn't mean it is absolutely unconstitutional. The 'Citizenship Clause' of the 14th Amendment has been debated about for 150 years or so.

"The Civil Rights Act of 1866 had granted citizenship to all persons born in the United States if they were not subject to a foreign power, and this clause of the Fourteenth Amendment constitutionalized this rule."

This is usually reserved for children of foreign diplomats, children of enemy soldiers on US soil, etc. However, it has been used on cases of children of illegal immigrants and some were ruled on the fact that the parents had a house here, so the child became a citizen.

Someone squirting out a child as they cross the border doesn't always mean they're automatically citizens.

I think there's room to compromise here, and do it right by congress... No retroactively revoking citizenship.. only affecting babies with both biological parents being illegal. Not affecting babies of a visa or green card in good standing, or with a natural born parent.
