Capital police are investigating this incident because it is a clear violation of his 4th amendment rights against illegal search and seizures
Police are not allowed to just enter someone’s home and take a bunch of pictures just because their door happened to be open. They can only enter for a welfare check of someone’s safety, and then only to perform that function. In this incident they could try to argue that they had suspicion that a crime occurred that they were trying to document by taking pictures I personally would sue them in court. Because they would not be able to prove to jury that the reasonable explanation for a door being open is that a robbery just occurred versus the person just accidentally left the door open. For suspicion of something like a robbery there would need to be more evidence such as damage to the door, belongings strewn about in the room, etc He should sue, based on what I learned about police procedures from the ATA channel, he would likely win the case | ||
