Honestly, though: THJ could have fought this case. But their lawyers really scuffed it up. Daybreak lawyers are really dragging the THJ lawyers through the mud on this one.

If you were laywer, as in if you're THJ lawyer: How would you continue on after the judge treats you like a law student, and the opposing counsel absolutely tears apart your every argument, successfully?

I guess you gotta just dust yourself off and try again in the next litigation.

Quote:
Defendants have taken two, contradictory positions in this litigation:
 Pre-Motion to Arbitrate: Another Quest LLC, not Defendants Takahashi
and Taylor, is the proper defendant. See, e.g., Stipulated TRO at 1, n. 1
(“Defendants alleges that the company that operates THJ – Another Quest
LLC – is the proper defendant in this matter, and allege that Daybreak has
improperly named the company’s two members, Mr. Takahashi and Mr.
Taylor, in this lawsuit.”); PI Opp., Section IV(B)(4) titled “Daybreak’s
Complaint Names Improper Defendants.”
 Motion to Arbitrate: Defendants Takahashi and Taylor are proper
Defendants and purportedly are bound by the Player EULAs. See generally Motion to Arbitrate (The first sentence of the Motion states, “Defendants
had to accept the terms of an End-User License Agreement to play
EverQuest.” Id. at 1.).
Damn, I miss Boston Legal

And since I keep forgetting you can't edit:

The defending lawyer would be played by some snivelly actor, who is made to look a fool by the great William Shatner as Daybreak's counsel. The defendant would be seen in the hallway after the outcome yelling at his inept lawyer, as Shatner leaves confidently winning an easy case.

He'd walk around a corner and bump into James Spader - and kick off the real thru-line plot of the episode. The THJ takedown would just be the cold open to the episode.

Later in the episode, THJ lawyer would show up to Shatner's office drunk and with a pistol - claiming that Shatner's character ruined his reputation and he can never get hired again - and Shatner would have to talk sense into him, before the police arrived and hauled him off to jail.

Can't forget Paul Giamatti, he's a shoe in for this cast.

I think Scott Baio would be a perfect fit for the THJ lawyer.

"Your honor, my defendants are not under litigation today - The Heroes Journey is. THJ never entered any agreement not to steal Daybreaks IP."

2 weeks later

"Your honor, The heroes Journey is not under litigation today - my clients are. And they signed a EULA stating they had immunity to litigation and would be subject to arbitration"

I mean somehow that calvin peeing bumper sticker managed to win its lawsuit against the creator.

You never know.

But I couldn't imagine thinking what THJ was doing (hack/modding another IP against their wishes) being a stand your ground type situation.

"Your honor, when my clients forgot to remove the license.txt from the THJ files, it's because they didn't know it would be used against them in future lawsuits."
