That's probably key in this case, and I'm of the opinion that there was no mutual assent, enforcing would be unconscionable etc.

the lawyer retardation forced me to look at that thread again and just as I confirmed from my steel trap memory, he backed out and made an entire paragraph of excuses as to why he wouldn't accept the challenge (I may exploit, guild level me, get buffs outside group, use bugs, etc - aka everything he chose to do after I had stopped logging in as the highest niglet on the box, with the 2nd highest character on the box as well [sorry kringe]) yawn, thats law.

So you're trying to argue PE- this fails on 2 elements not being met: reliance, and injustice. (PE is rare, injustice actually means something).
