No? The new guild's leadership had nothing to do with the decision. FE members Slydexx and that piece of shit Visceral acted in conjunction with FE leadership and determined that using stolen loot to complete a necro epic was kosher and the next eye was to be placed in the FE guildbank.

I feel like I'm taking crazy pills. How can any sane person think that FE was justified in acting this way?? It's STOLEN LOOT. Thou shalt not steal. This is a very basic concept.

which FE leadership did so? Also slydexx had the loot and didn't feel it was stolen do you have anything to back up him just holding it until a necro needed? Perhaps with two already banked he thought it was his to keep? Again I have no idea what happened, but that seems to be his side that he felt it was his eye yet you and the rest of BDA say he was holding it in good faith.

Why do you give the Eye of Innoruuk to your wizards and not your necromancers. Does BDA not have any active necros who deserve an epic piece?

We have necros that deserve them but most of the time our necros end up on bards or clerics during raid situations. We let wizards hold them until that time comes to use as a nice clicky/resist item.

Justified? no definitely not and it is an extremely shady tactic but you keep going after them because they have it now, why dont you go after the guy that stole it in the first place? at least then hed be getting some sort of punishment, if fe gives you back the eye sly wins wins wins....
