It's also the fault of the person taking who took the phone. Regardless of the carelessness of the person who left their phone the OP is still trash if he doesn't return the phone. To reiterate: I'm not saying he's trash for not seeing the phone and making an effort to return it to the rightful owner. He's trash for taking something that doesn't belong to him and keeping it. You're an idiot if you walk through a dark alley in a dangerous part of the city but that doesn't take away the responsibility of the person who ends up occupying your anal cavity.
