Sirken we need a clarification on people stating the DT cycle in fear

Is it legal for a raid to start the DT cycle inside fear while their force is outside?

Scenario,

Raid A is inside clearing

Raid B is outside. Raid B sends someone in to start the DT cycle causing everyone on inside to be on the DT list. This forces the guild inside to camp or die from the DTs. Raid B then zones in after the cycle is started. By doing this they are not on the DT list.

I wanted to get a 100% clarification on this so there is no one banned/suspended without knowing.
