For starters, DBG only sued THJ. DBG stated their tolerance of the other EQ emus in court docs. They clearly see a difference and that difference is monetization. If DBG wants the others shut down, they need to file to do that.
THJ's defense seems to be that they are just a regular emulator, but DBG clearly established that is not the case.
If you look at the other EQ emu numbers, they're really not that big other than a few. Three of those servers have known agreements with DBG. While I am not 100% certain regarding boxing on the other servers, many do encourage boxing which skews the number counts. Were you to adjust them for actual individuals, the server populations would be much lower.
Please don't waste my time defending THJ. They broke the law and that's that.
