search warrants were executed for marijuana. Texas Supreme court ruled scent of marijuana is exigent and does allow you immediate access to an apartment or unit in the state of Texas.
She has 2 avenues for defense she can go with.

That only works if she was aware that it wasn't her apartment. Her defense was that she thought it was her home. Why would she execute a search warrant for marijuana on her own home?
