Both, it'll hopefully cover your tail in case it does turn out to be a duped item that they remove so you don't get in trouble. However their stance is that you assume all the risk when trading accounts so you may still be out of luck.
It really depends on how Sirken decides to handle it. For all we know this could (though extremely unlikely) turn out to be a legit stream of AoN's for sale, but in my 3ish years here I've seen probably 3-4 amulets going for sale in all that time. For there to suddenly be an outpouring of super rares is quite suspect.
