Default damage hardcap 40%

on the sony live servers.. there was always a 40% of target's max hp, on players in pvp. to prevent wizards from 1 shotting, or even 2 shotting people.... why is this not implemented here? i understand that the damage is reduced by 30% but that 70% of base damage could still do 100% of my hp, if i was at full hp, unbuffed... where as the live system.. only 40% of my max hp... to prevent casters from being too overpowered and givng the target at least some chance to flee or defend themselves.

That didn't come into play until after AA's were introduced.
