I created a new account and i went to play and it is telling me i need to update my files? any tech savvy gamers around??

Go here and download the spell files (v36): http://www.project1999.com/forums/showthread.php?t=2651

These will be a .zip file - extra them into a folder. You'll see some files and folders - copy all of these into your EQ directory and overwrite everything.
