She's so dumb, that big judge looks quite friendly, she could have gotten out with à 5,000 $ caution n she dropped with 10K and 30 days of jail. I mean wow, things can escalade quite quick in US courts!

She looks high as a kite if her lawyer was not some shitty public defender she would not of even been allowed to stand there for sentencing.

Also with no priors she could of asked for rehab and had it granted most likely

Nah, the judge is actually acting like a jerk. Yeah, the girl is obviously an idiot but the judge disregarded her public defender's request to be appointed to act on behalf of his client. The girl had obviously not been briefed on what is expected of her when she goes before a judge. This clip doesn't show the extra two minutes of footage where the judge admits he screwed up by ignoring the public defender's request.

I'm pretty sure the contempt charge is already dropped due to the judge ignoring the PD's request before the situation blew up. The added bond will probably be dropped as well.

This is ffirst appearence not her trial. The judge rhas the option to ROR her on her charges or set a bail. The bail id almost completely up to the judge with some restrictions. There are monetary ranges depending on the infraction.
He set her bail at 5k for the possesion charges which id on the low end off the alotted range. When she gave him the finger he was well within his duties to max her bail at 10k5k and slap her with contempt off court. Welcome to american judicial system.

No one is making the argument that judges work as emotionless robots. But judges can't violate procedure with impunity regardless of how entertaining the viral web video may be.

kenzar
02-06-2013, 10:43 AM
For the most part at arraignment judges dictate procedure with a few exceptions. She will get her day in court at her trial until then its the judges day. Have you never had a 1st appearence. Before?

Hitchens
02-06-2013, 10:45 AM
Evidently this is a case of one of those few exceptions.

kenzar
02-06-2013, 10:49 AM
Yeah. When u have a first appearance the judge looks at your charges and then at your previous charges. The judge has a certain range at which to set bail or if no previous record he can ROR (release on own recognicence) the person. The only right you have at first appearence is the right to a first appearence.

Anyway, I'm pretty sure there are already pre-set maximum bails set for every crime. A judge can choose to either give the maximum bail or a substantially lesser amount based on the person's situation, income/assets, and if they are a flight risk or not (based on severity of crime.)

Congratulations, you can point out that our judicial and incarceration systems are extremely flawed.

The parts that are in bold are not exclusive to all incarceration systems globally, they are only true in nations where the authority in power decides to cater to people who don't wish to abide by the laws that are required to maintain the state of being a citizen.

Don't assume that I support the fact that we feed, clothe, give medical attention, physically train, school, provide entertainment mediums and even pay these murderers, rapists, drug dealers and gang-bangers while they are in prison. The system is broken, however, acknowledging such doesn't mean that I'd rather have these people running free to do harm to more people, flawed prison is the lesser of two evils in this case.

The same goes for the death penalty, the idea of the death penalty isn't flawed. The appeals system, and the fact that it takes 30 years to put someone to death who has been proven guilty beyond ANY reasonable doubt is ridiculous. This isn't even taking into consideration that the state is paying to keep this person living essentially comfortably the whole time.

I tried to chase a tenant out of my house by knifepoint (he was larger than I am) and he called the cops. I spent a night in jail but the painful part was the bail money. When I went to court, the judge gave me time served, could have given me 3 years. I dressed well, spoke clearly and respectfully and didn't cause him any trouble.

They definitely go by personal emotion.

I do. I was also taught this thing called respect. Something that seems to be lacking these days. There's also a thing called contempt of court to encourage this respect.
