Not sure if anyone follows Nascar at all, but Tony Stewart killed a guy on a dirt track race today. Video is online (for now).

Looks like he sped up rather than hitting the brakes, what a dick.
Not going to claim that I'm an expert at car racing but everything I'm reading says that on a dirt track with those specific types of cars, revving up the engine will jerk your car left so his speeding up was very likely Stewart's conscious effort to NOT hit the moron walking in the middle of the race track.

What really happened:
He knew he caused kid to crash by turning high but felt it was the kids' fault not his. When he saw the kid outside on the track QQing, he tried to scare the kid by driving close, revving engine, etc. He accidentally hit him as a result.
At the end of the day, 2 wrongs do NOT make a right. Also, he probably won't be found guilty by law, but he is guilty by court of public opinion. He can rot in hell for all I care.

He probably should have stayed in the car, but why did nobody else have a problem avoiding him? The race doesn't keep going when there is car spun around in the middle of the track you know.

The race does keep going, under caution, so they are going 30-40 mph still around the track. Tony started to try and get low, but you have to steer with the accelerator with the way that you have your car set up on a pitched dirt track - pushing the gas uses the weight of the car to move down the track, etc.

This presents a very interesting legal problem. Whatever it was that tony did, the question is did it create a reasonable certainty that that kid would be seriously injured. That is enough for murder in most states. Probably just get him for wreckless homicide, or maybe nothing.
On a side note, if tony reved his engines to scare him, then that intent would be imputed for purposes of committing battery and wrongful death, with some nice punative damages.
Tony is going to owe that dumb ass red neck's family big chunk of change. Sadly it'll be gone in one generation or less.

Tony Stewart isn't going to get in any trouble for this. The worst case scenario for him is that he looses sponsors. He may end up paying a big settlement in civil court, but don't count on him being convicted of a crime.

tony is fine, Darwinism took the kid out for running around in black on a dirt track (poor lighting)midrace. Revving up to turn/swerve is how those cars work. Literally he wasn't mad that some kid wrecked. The kid was mad and had something to prove but went about it all wrong. Also I live a few minutes from there and know that track fairly well.
Tldr: terrible accident but is the victims fault. Rip
I'm no expert. But it looked to me that he was being reckless with his vehicle.
I think many others on this board agree. So I would say speak for yourself.
There is no doubt that he will pay millions on a civil suit.

Tony has to live with the guilt of this accident as well its a shame people bias their decisions on past actions. I doubt that Tony Stewart even saw him until literally the last second, if at all. Dark clothing plus view possibly being blocked by the car right in front of him that also had to swerve as they were coming out of that curve.
That was really dumb. Sorry he died but it was his own fault.

Tony might have been able to do something to avoid the kid, but that doesn't excuse walking into the middle of the racing line on a track with an event in session. This is a sad event for everyone involved.
I'm not a big fan of Tony Stewart or NASCAR in general but given the dim track lighting, and the way these cars turn (they don't, unless power is being applied), I don't think he did anything wrong. Kid should have stayed in his car and saved his raging for the pits.

Sure the guy put himself in harms way. But that doesn't matter.
He put himself near Tony's car. It sure as hell seems to me that Tony caused the back end of his car to either hit him or come close to hitting him. Proving it is something else.
I never said tony will go to jail for this. He will pay that mans family a good amount of money though. Let's just watch and see what happens. New York is comparative fault. So even if the deceased was 90% at fault, his family will get some cash.

Way to not see the whole picture. The issue here, in your example, would be whether or not people deliberately shot at you when you walked across said gun range.

I have a PhD in Laughing At Unintended Genetic Help (LAUGH for short). Of course it was a tragedy. But hundreds/thousands of people die in some tragic way each day. And in this case, it means one less idiot in the world, which is great for not only the gene pool, but the ecosystem, economy, culture. The human race has been touched on this day.

Was the guy a moron? Yes. But that is par for the course when it comes to race car driving. Stewart did a similar thing after getting pushed off the track a few years ago.
Additionally, it's worth noting that the guy was not standing in front of Tony. He was standing to the right of his vehicle, pointing at him. Tony did not need to avoid him.
It is my opinion that this incident is sketchy as fuck. That is my legal opinion.

No, it would be more of an "if you walk across a blacked out gun range, where shooters cannot see what they're shooting at, whose fault is it if you got shot"
Realistically, between the low light, the speed, and the constant turning, their visibility is extremely limited, and they don't always have the time to react. Tony Stewart will not see any criminal action about this. he will however, lose most of his Sponsors.
because 30 mph is break neck speed for someone like tony Stewart.
