While yes, most likely in that scenario the person doing the killing isn't interested in the loot and probably doesn't give a shit that you're looting it. However based on p99 rules its not allowed and if that player doing the killing wanted to complain about it the person looting will get in trouble.

I agree with you that the lockout loot timer should do the policing itself (after all im pretty sure why its designed that way) but that's not the rules here.
I’ve literally had multiple petitions get answered the exact opposite way so...

I'm confident that Amonet/Oarsome gated out to avoid more exposure while 2boxing. It's also reasonable to say that at the same time, the yael spawn did happen. Based on my logs, I'm willing to guess that the yael kill happened sometime shortly after:
