If the penalty for dying was reduced much, Nihilum would have had to actually earn the raid gear they could farm for months unchallenged in Fear, through pvp.
The way its set up, all they had to do is come up with zerg numbers, this assured that nobody even wanted to try cockblocking them.
You end up with pvp that is like Founding fathers waiting for stragglers at entrance

Im not saying it should be totally removed, but drastically reduced since im sure item loot wont be implemented
With that heavy a penalty, its just a game of "Who can recruit the most people the fastest as they reach our lvl bracket"
It discourages people on the server from forming smaller guilds, and encourages large 2 party guilds that tip over once the numbers start shifting one way or the other.

4% isn't much unless you die several times, but that is totally subjective. It certainly isn't enough to stop people from bind rushing, because that still happens all the time.
Nihilum did "earn" their gear because they did fight. They were challenged, and they won. You can debate the whys and hows for eternity, but the fact remains that Holo and FF both contested content and both no longer exist. In any case, they certainly didn't fold because they got deleveled 4% at a time.
Larger guilds are necessary here because of the brutally high resist thresholds on this server. On live I never raided because I didn't find assisting someone and hitting 1 a lot of times to be enjoyable. I had no problem gearing and enjoying my toons through item loot and a little trading. Here, you either raid or just accept your toon being shit. 120 fr/cr here is useless, you won't partial anything; 180 fr/cr and you will partial over 50%. But you won't get to those critical mitigation values without the big numbers that you get on raid gear.
I think people don't stick around because it's not fun to get 2 shotted when you have put a pretty respectable amount of time and effort into your toon. It's not fun to basically be on even footing with someone wearing crushbone gear because 120 resist has the same effect as base resists. It's not always fun to constantly fight an uphill battle against what, in many cases, are shitty players with amazing gear.
And I'm probably one of the few people who actually prefers this resist code.
