Below 40, I've encountered tons of nice people on this server. But the people at the top will always be that elitist mix of player where it's very, very hard to be nice. ESPECIALLY on a PvP server.

The low population does hurt it, yes, simply because a larger proportion of players on the server are those elites at the top(/who all Nihilum sometimes accounts for 40%+ of server pop, if you throw in /who all Holocaust and /who all Founding it's like 70% at times).

All the more reason to encourage new people to play. Although, it takes a specific kind of player to be able to survive on a server like this, so not all players will be capable of sticking around.
