Right now, the rules say it's a raid mob, as it's included in the server raid rules. So that's what people who would like to follow the rules will go by, and then become frustrated when someone says "Oh, but this is different." And then a member of staff rules in their favor. And the rules never get changed, so no one knows what the hell to do.
And even better, next time a group of people use that precedent to claim a mob as an exception, they have a non-zero percent chance of being ruled against based the way the rules are laid out. Which is what they were going by the first time when the exception was made.
What is the point of having the server raid rules out for everyone to read if everyone is just picking and choosing which parts of them they want to follow?
Change the raid rules to drop Phinny off the list, IMO. Or use them consistently and without exception when making a judgement call.

It's been claimed as a group mob for over a year. Anyone that has done it, knows it. Anyone who did not know it that night, was made more than well aware of it before it spawned by a senior guide. I know you are more than aware of pet classes downing phinny for the past year+ with a single group (often much less), you're just rule lawyering for your own benefit.
The raid rules you love to quote are old as dirt, no ones fault but the over worked staffs, so blame them if you want.
