The terms don’t literally say “as long as you’re not profiting off the game’s IP you’re in the clear.” What they actually say is that EQEmulator is allowed only for non-commercial, fan-based use, and Daybreak (the rights holder) can shut you down anytime for any reason, even if you are following the non-profit rule.

So in plain English: yes, you’re mostly safe as long as you’re not making or taking any money or value from running an EQEmu server — no donations, ads, perks, subscriptions, or merch. But “in the clear” isn’t guaranteed, because Daybreak still reserves the right to revoke permission at any time.

So the short version is: non-profit = tolerated, but not legally protected.
