There's a flaw in your reasoning: the Daybreak agreement preceded Green's release. That means P99 had two servers, they signed the (secret) deal with Daybreak ... and then they went and released a brand new server.
Plus, even if that secret agreement did cap P99 at three servers, it wouldn't be a relevant limit. The staff only needs two servers to realize their vision: a "Classic" "recycle" server (ie. Green) that lasts 3-4 years and then resets, and a "Classic+" server (ie. Blue) where all the recycle server players get sent every time it recycles. Both servers already exist.
Now, none of us knows what's in the agreement ... but we do know R&N signed it to safeguard the future of P99 ... not to kill it. So, it seems far, far more likely that the lack of a new Gold/Green 2.0 server falls entirely on Rogean and Nilbog's shoulders, not Daybreak's.
(And in their defense, new servers are a lot of work; they discovered just how much when they launched Green.)

There is a flaw in your reasoning also - the agreement was made BECAUSE of Green launching and they said "OK you can have this one but cut the shit and stop releasing servers".
Thus no Discord server, thus no new PVP server, thus complete radio silence on anything relating to the future of P99
