Fetuses are not treated as people for the purposes of murder. They are specifically written into the murder statutes in addition to human beings. For instance, take the state we live in, see the relevant section of California’s murder statute, Penal Code s. 187(a):

“Murder is the unlawful killing of a human being, or a fetus, with malice aforethought.”

The statute then goes on to exclude the medical termination of pregnancy in most circumstances.
