I'd say it has to be willful. There has to be intent to end the pregnancy.

Haven't there been cases where someone was prosecuted not only for killing a woman but killing the woman's unborn child along with her? Should I google it and see if my memory is correct?

I don't understand this or who you are being critical of here. I think about all kinds of things, sometimes at the same time and sometimes later down the road. I just find it amusing how quickly our public outrage disappears when something new to bother ourselves with comes along.
