Ya, but it does matter when determining sentencing for a particular crime, which is why it is difficult/unfair to compare sentence lengths across ethnicities, since they may have different criminal histories. In order to compare sentencing of x ethnicity vs y ethnicity, you need to use 2 people with identical criminal histories committing an identical crime
