It was an agency policy. She was the head of the agency. Your about as likely to go to jail for breaking agency policy (assuming you haven't committed a serious crime) as you are for breaking a store policy. It's not uncommon to get fired for it, but no one goes to jail.
Clinton is shady I get it. But the reality is few in her class would get into legal trouble for something like this -- they would just have some (temporary) employment problems.
