I'll admit, I don't read many reports from civil court, but apparently they're phrased in the nicest way possible. Sure, if you interpret it as a layman, "probably generally aware" doesn't sound so bad. But if you read it as a civil lawyer (like the person that wrote the report), it's a pretty strong indictment against Tom Brady.
Yeah, because habitual cheating isn't harmful to the sport at all.

The phrasing is used to establish guilt in a civil court generally. Enough for a civil court not enough for a criminal court.
