It could be done; some data for items is item-instance-specific and stored in the inventory table (e.g. current charges, augs in later expansions). Wouldn't be much harder to put "level of maker" in there. But good luck confirming that was something they actually did. (edit: lol at "impossible" though)
As for spell scaling thing... could see that going either way. Most all spells that scale do so from a base at level 1, any minimum is only relative to the lowest scribe level. Looking up the lowest scribe level is easy, but would make it pretty arbitrary in the case of spells with lots of different scribe levels for different classes. They did a lot of odd things though, maybe they decided on that after they'd written their spell scaling system in stone and didn't want to reorder things to make the minimums more explicit for whatever reason.
