A single guild, probably not. A large group of players using harrying tactics, maybe. My point is that it's is more interesting than a metagame which revolves around ninjalooting and dodging PvP, which is what variance would encourage. The variance argument is basically "Nihilum is too stronk and we can't compete, so the staff should change raid times so they suit everyone else instead of Nihilum!"
As I see it, the problem is that variance a) doesn't suit anyone but batphoning neckbeards, and b) is being proposed specifically as a way to depower Nihilum. I don't think that it would succeed, but it's not fair to make rules just to nerf a guild.
Rather than pass rules that make it easier to sneak around and dodge PvPing with Nihilum's force, I would much rather the staff change the system so that it encourages PvP. Simultaneous repops, more frequent respawns, a server wipe (preferably with teams instead of FFA), and many other solutions would encourage more PvP. Variance only discourages actual competition, as in competing to see who can kill the other raid and take the boss.
A lack of PvP, and a lack of reason to PvP, are both much larger problems for Red than Nihilum will ever be.

You think other people are asking for help from the staff! LMFAO guess you don't know much about Red99 or how it really works here. WTF do you think makes sure everything goes Nihilum's way since day 1?
