That's the reimbursement policy on live although it refers to raid encounters. They do take action against ninja looters and they still would if it was in the case of an epic mob or such. 10.2.1

Items freed up to the public is not a topic of ninja looting. Ninja looting is when a person procures an item before others in the group or raid who have rights to it have the opportunity to receive it. That's why they call it ninja looting. Regardless, there were no rules against ninja looting in classic EQ.
