At worst, Sony has a civil claim against P99 for infringement which they have, thus far, chosen not to pursue. In fact, there's more than a few murmurs that Sony and P99 have an "understanding", part of which is the active policing of RMT. You're absolutely right that P99 does not own the game, and that they cannot modify, control, and distribute copyrighted files without potential penalty. However, they do own the server which your connecting to, and it is more than appropriate for them to cut off access for people they deem unfit.

The moral and ethical justifications for disallowing RMT are largely irrelevant. It's against the rules, and if you want to play here, then don't do it here.
