Just playing devil's advocate, but in defense of the poster, while a lawsuit would rightfully be thrown out of court, the media would probably have a field day with such a story. The love a controversy, no matter how absurd.

Corporate culture being what it is, I could see Daybreak doing something in response, too.

Someone would probably have to die to get that kind of attention though, for an old game that's now very niche like EQ though. Not very likely.

100% agree with this post.. i even said my legal post they may not win...

its the optics.. Also p99 operates with some type of permission from Daybreak.. I would imagine that its not some verbal approval.. there would typically be a clause that ensures they don't do something to disparage everquest...

The only reason to camp this is to sell it for a million plat in 6-7 years when 98% of the characters played today are rotting on some account that nobody logs into.

Didn't read any of the learned discussion since the first few posts, but yeah. I'm just boggled at this whole deal. Like, if you could press a button that gave your ass painful electric shocks but was guaranteed to drop a manastone in 80% of the time that the current wait was, I bet people would LINE UP for that too. This is like some kind of weird skinner-box experiment that somebody is running...I think aliens but could just be Rogean.

Yeah "thrown out faster than..." still would mean it gets filed, likely gets publicity, and then has to wait to go to court to get "thrown out" in the first place. We all know it wouldn't win but that doesn't stop anyone in the litigious US. By the time P99 is cleared of any wrong doing, the damage to our little hobby game would already be done.

If I were the plaintiff (I'm an estate planning/probate administration/medicaid planning sort of attorney, and it's been a long time since law school, so sue me (lol) if my idea is horrible), I'd try to push the analogy between a landowner owing some duties to invitees and licensees and the players' status on the virtual landscape of p99.

I guess it probably wouldn't get anywhere in most/all jurisdictions though because even if the players are invitees, the dangers of staying up for ridiculous amounts of time at a manastone camp are obvious.

Then again, more retarded legal theories have come out on top now and then over the years.
