certain bugs, such as heartbleed for instance, operate on the kernel level. If there is such an exploit that can turn on someones mic, or camera for instance, it would absolutely have to operate between the OS and the hardware for it to be considered a threat or even an exploit. Simply turning airplane mode on, which works on the OS would immediately be altered in the kernel before the command ever hit the hardware and computed.
Plus airplane mode afaik isn't a total stop transmission command, more like a hold transmission until later command. You're phone is still in constant contact with towers and satellites. Its still very much sending and receiving information, it just doesnt display incoming info to the user until airplane mode is turned off.
