Plan:
Phase 1:
1. Use existing IP and previous hobbyist developers work to create a popular server.
2. Monetize using pay-to-win and cosmetic microtransactions.
3. Lean into the narrative that big game development companies are trying to squash the little guys out here just trying to make enjoyable game experiences.

At this point, now the rabid fans who willingly spent dozens, hundreds or more of dollars in microtransactions on your stolen IP project that used borrowed code will be part of your "cult."

Phase 2:
1. Use the profits of your first venture grifting people out of their money for 6 months worth of gameplay to pay your out-of-court settlement to the IP holders, and pay your lawyers for their shitty attempt at defending your case.
2. Start a kickstarter for your next project, which will also be using other people's IP and borrowed development work.
3. If you decide to try and launch: Go back to Phase 1, otherwise, proceed to Phase 3.

Phase 3:
1. Create artwork and assets using AI. Release these as "teasers" of the work you've done so far.
2. In Blender, create a "gameplay trailer" that includes absolutely fuck-all that will actually be in your game.
3. Do Live Q and A's to reinforce the belief in your cult following that you are actually good developers and capable of taking on such a task and "re-defining the MMO Genre."
4. Ghost your Kickstarter backers by slowing down on your "trailer" releases and "asset creation" previews.
5. Claim that the fallout from your Phase 1 endeavor has you nervous to launch a new title.
6. Lean into the narrative that your cult following will create, and play the role of wounded, benevolent bird.
7. Keyser Soze with their money. It's up to you if you want to return to either Phase 1 or Phase 2 on your next project. Your dumbass, highly regarded cult followers will still be with you for another few cycles of this.

I remember when Shards of Dalaya branched off to make their own failed momoperger. It's nice to see one with modern graphics. No roadmap but there's plans to make a roadmap lawl.

I don't have social media, I don't follow any influencers, I haven't fallen for a single scam, I don't donate to obvious Kickstarter grifts, I don't pay for microtransactions in game, and the only cult I belong to is the cult of Project1999.com forums.

I enjoyed my short time on THJ.
It wasn't a replacement for EQ, but I like ARPGs and I like EQ and it was a fun combination.

Won't give them any money in advance but would probably check this out, but admittedly a lot of the draw to THJ was the EQ content.

Yeah, the way they like, managed to capture the feel of EQ but make it a different game, is what I hope I feel in this new IP they can sue people for emulating.

I hope I like their new art, i know one of the devs is a fan of the luclin models, so I have lowkey been afraid of them making their own game, but Im going to hold out hope.

They settled and will have to pay Daybreak an undisclosed amount. They agree that Daybreak would have been able to prove $3.5M in damages if the trial went through.

But if I wrote a book that became a best seller where Legolas was not just an elf prince but also a hobbit lord, and you could purchase new outfits for Legolas in the story with your own money, without getting consent from the Tolkien estate?

In short, the settlement heavily favored Daybreak with a permanent shutdown/injunction but imposed no actual cash payment from Takahashi or Taylor at the time of resolution. The $3.5 million is purely a conditional penalty (often described in coverage as a "threat" or "IOU" hanging over them), not money they paid to settle.

The Takahashi party (Kristopher Takahashi and co-defendant Alexander Taylor, operators of the EverQuest emulator "The Heroes' Journey" or THJ) literally paid $0 to Daybreak Game Company LLC to settle the copyright/trademark infringement lawsuit brought against them.
